Long Walk Ahead for applicants as Div. Bench of Patna High Court to hear BPSC,53-55th PT case on Jan,9

Patna, Jan, 7: It seems that the legal web is not going to end soon for the aspirants of 53-55th Civil services examination conducted by BPSC as the applicants moved ahead with their LPA to the division bench of Patna High court that include Hon’ble Chief Justice Miss Rekha Manharlal Doshit and Justice B P Verma against the verdict given by Justice A K Tripathi on Wednesday.

The matter will be placed for hearing in front of division bench on Monday-Jan-9.Senior advocate Manan Kumar Mishra will represent the case with the prayer that nine marks will be added in the marks of unsuccessful student and cut off will remain same as it is and then additional result will be declared.

Earlier single bench of Patna high Court headed by Justice Tripathi has directed the BPSC in his verdict that a fairer approach to the whole problem would be by permitting BPSC to carry out a fresh evaluation of all the answer sheets of the PT on the basis of their stand emerging from the opinion of the second expert group it will amount to a fair evaluation of all the candidates without giving any unfair advantage to either successful candidates or the unsuccessful ones because they will all be tested on a common platform.

In fact this is one of the reasons why this Court is not accepted the submission of some of the counsels that as many marks should be added to all the candidates treating them as correct answers to the incorrect questions. In the minds of court such an approach will make no difference to the final standing of the successful candidates whose results have been declared.

Justice Tripathi comes to a conclusion that the BPSC should now re-declare the result of the preliminary examination after a fresh evaluation on the basis of the recommendations of the second expert committee and that should form the basis for conduct of the mains examination which is yet to follow.

It is made clear that none of the successful candidates earlier declared successful on the basis of declaration of the result would be ousted from the list of such candidates who will be entitled to sit for the mains examination. If the exercise brings in more candidates within the zone of successful candidates by being permitted to sit for the mains examination, so be it, but the exercise shall not be done to the detriment of any of the successful candidates.

Court has also considered earlier judgment of various cases across the country in this context while pronouncing the verdict.

What does Justice Tripathy means by serious candidate? It is not so that serious candidate means only 10% of total appeared.Any layman can say that for 3 years backlog of BPSC THERE CAN BE MORE THAN 50000 SERIOUS CANDIDATE

Judiciary exam mein 129 cut-off out of 225 correct questions. Around 57% mein pt. qualify. Agar is case mein 9 marks reduce ho toh... 95 cut-off out of 141 correct questions. Around 67% mein pt. qualify.Tab bhi judiciary se jyada serious student mains denge.

Fighting n seeking justice on wrong ans is right thing.but how can a examinee demand n suggest 4 a particular cut off in a competion.comptetion is a process to choose the highest scoring group.its a process of selection cum rejection.its different 4m academics.16000 r sufficient for mains in case 600 posts.rest 15400 r bound to fail in process in any case.what i think fail student should take it with sportsman spirit and shoudnt try to bend the rule.i know its very 2 painful but thats life friend.but future is always glorious who learn 4m their pain.and u see nothing will happen in this case.case has no any ground now.mr manan know it but he has his profession.he will never say no.may be sm1 find my comment unpleasant,but its my view.u know my wishes r with u frnds.

Are bhai tum kaun hai saadhu ya sanyasi.Judiciary waala decision dekho. 55% se jyada mains ke liye qualify kiye.Jyaada mains denge tab bhi seat utna hi hoga. Agar Commission galti nahi maanta toh alag baat tha. Constitutional body saalon saal galti karta rahega. Kya majak hai

bpsc has released 5422 additional results based on 100 marks cut-off for UR candidates around 11pm night…. first of all congratulation to all successful candidates who are in the new list from our fight against this system and friends this is the first step

this shows for saving 915 previous successful candidates bpsc has lowered the cut-off by 4 marks…
so friends the final judgement will come from the division bench… keep ur eyes open…

anyway i am in the list of new additional list of successful candidates but not feeling happy because of my some more freinds who are still waiting for the same…

i am with you friends to fight against this corrupt system…. and hopeful will win from double bench and if not then will go to supreme court…
