To giving big relief to the successful
students in 53-55 PT Examination in its much awaited judgment Patna high court
directed BPSC to reevaluate the answer sheet of PT examination on the basis of
the model answer given by the second expert committee.
Order also directed the BPSC
to exempt the successful candidate as they have already filled their mains
form.
According to interpretation
of this judgment few thousand new candidates will get qualified as per affidavit filed by BPSC in the court.
BPSC has also got green
signal to conduct the mains examination with this judgment.

No word has come out on behalf of BPSC regarding the criteria for reevaluation. So I think they have a lot of discretionary power in this regard, and this number of 588 candidates getting benefitted is merely a speculation.

ReplyDeleteAt the very onset I want to congratulate 600 odd aspirants who will get chance to participate in the mains. Tough luck for those who deserved to be in but could not get chance due to worst system prevailing in our country especially in Bihar. Hard work never goes in vain!
As regards to Justice Tripathi he has to survive himself. That’s why he killed time and was always in favour of respondents in this case! Even when they accepted their mistake at this level. Perhaps his career progression depends on General Administration of Bihar that’s why! If not so why he always gave time to Commission and it’s so called experts. Perhaps the single judge who rightly gave judgment during 48-52nd BPSC Examination was honest one. But the result was, his judgment was reversed by double bench.
There was an incident in previous batch perhaps 42nd batch of BPSC wherein a data entry operator kept on daily rated basis had wrongfully (hopefully) missed names of 16 top reserved category aspirants and they were not called for viva. But as he was not so called expert his mistake was taken note of and aggrieved candidates got justice! This is not applicable for these super experts! They are privileged ones. In the judgment that followed those who wrongfully got higher ranks were not given appointment letters. Even some were left out after revision.
Is not it funny that Justice Tripathy is saving those who have already filled forms of mains and that is why some odd 600 are getting chance. What a judge and what a judgment?
Wish me luck for mains and if I am unable to get through the tough competition and unprecedented obstacles of the system I will be back to try my luck in the next batch.

Jisko lagta ho ki ye case double bench mein le jana chahiye wo jara apne wakeel se kah dena ki judge ne jo past precedences apne decision mein mention kiya hai un past cases ko ek bar dekhne ke baad hi koi step lena.
Jyadatar petitioners aur unke lawyers to judgement pura padhne se pahle hi hawaa mein kila bana rahe hain.... Lekin ek bar pura decision padhne ke baad hi is case per aur paisa fookna tum log.

Tum log bane hi ho shasit hone ke liye aur usme bhi nakaam rahte ho and you suffer your entire life due to your lack of proper basic education.

Suppose in case of General category pahle kisi ka 104 marks the (jo ki cut-off hai).Ab 3 questions further delete huen. Maan lijiye uske yeh sahi the ab reevaluation mein delete karne se 3 marks kam honge.2 questions pahle deleted the ab sahi mana gaya. Maan lo yeh bhi uske galat. Minus further 2 marks.Maan lo doosre candidate ka yeh sahi ho.Salinity wala option change huaa uska woh bhi galat ho gaya. Yaani total 6 galat. 104 se seedhe 98 ab bolo. Kya yeh successful hoga after reevaluation.

To fight injustice is also preparation of Civil Servant.In 48-52nd BPSC first judgment was to scrap the pre. exam but after appeal it got reversed.So fight when there is something wrong. Judiciary,experts, BPSC counsel are paid to carry out their job properly.No one is above a single aspirant. Aspirant does not have to depend on their mercy.He or She is general public. He has the real power. Injustice should not be meted to any individual. Refer judgment in case of Judiciary exam. Even Supreme Court approved it.Every Civil Service aspirant has the maturity as reminded by our Amit.

i ve 102 and after reevaluation 102 ...do u feel there is gr8 difference bet mine and ur marks ..so called successful aspirants who r teachig how 2 go about study and also telling in a way that they have been finally selected ....i ve written upsc mains also.....so it doesnt matter that i m not going 2 appear in bpsc mains.....and also wish all u passed ..get success in final xams also....
but when comes 2 justice....pls speak correct ..and say wrong what is wrong....and by going thru full judgement report.....i m quite sure that this is full of flaws ..at one point dear justice give rsn 4 not reducing cut off as unconvinience
2 bpsc also retaining 900 is not becoz it is for welfare of students rather 2 avoid further litigation..
so dear frnds.....v shud follow this case irrespective of our success / failure till last...
and yes all intelligent aspirants .u all pls dont give us ur fundas and better concentrate on mains prep....

ReplyDeleteपटना (एसएनबी)। बिहार लोक सेवा आयोग (बीपीएससी) की 53वीं से 55वीं प्रारंभिक परीक्षा को लेकर पटना उच्च न्यायालय के एकल पीठ के आदेश को दो सदस्यीय पीठ के समक्ष चुनौती दी गयी है। उक्त अपील पर नौ जनवरी को दो सदस्यीय पीठ के समक्ष सुनवाई होने की संभावना है। एकल पीठ ने बुधवार को ही अपना फैसला दिया था। उसके आदेश को कुछ असफल अभ्यर्थियों ने वरीय अधिवक्ता मनन कुमार मिश्र के माध्यम से चुनौती दी है और कहा कि नौ गलत प्रश्नों के अंक असफल अभ्यर्थियों के अंकों में जोड़ दिये जाएं तथा कट ऑफ वही रखा जाय। एकल पीठ ने अपने आदेश में कहा था कि असफल अभ्यर्थियों की कॉपियों का पुनमरूल्यांकन किया जाय एवं पुनमरूल्यांकन के बाद मेधा सूची में आने वाले अभ्यर्थियों को मुख्य परीक्षा में शामिल किया जाय। सफल 15137 उम्मीदवारों की उत्तरपुस्तिकाओं की जांच नहीं होगी। पीटी परीक्षा में करीब 15 हजार अभ्यर्थियों को लिखित परीक्षा के लिए सफल घोषित किया था। मामला 53वीं से 55वीं प्रारंभिक परीक्षा के पीटी रिजल्ट का
LPA has been accepted by the division bench of Hon’ble Chief Justice Miss Rekha Manharlal Doshit and Justice B P Verma against the judgement given by Mr Tripathi on Wednesday.

ReplyDeleteJustice delayed is Justice denied..this proverb is proved by the verdict given by Justice Tripathy. We do hope double bench comprising CJ will rectify the same and judgement given with malafide intention will be setaside. I wish to raise some points of double standard shown by the Justice Tripathy. He has given judgement not the justice.

Justice said once a candidate has been declared successful, his ouster from the list of successful candidates will generate another kind of litigation which the BPSC wants to avoid in the interest of cutting down further delay in conducting the mains examination. They are therefore willing to retain them… why.. and on what basis. Hon.Tripathy ji has to ensure the right of equality laid down in our constitution. But he failed to do so and pronounced a meaningless verdict.Why he was so worried if number increases for the mains exam. He said lowering cutoff by 9 marks will not be justified due to increased in numbers.. but he has not given the data i.e. how many students will get pass to sit in the mains. He praised BPSC for maintaining 10% in giving PT result and saying that Judicial PT case in the judgment relied by the petitioners which is the case of Akshey Lal Pandit v. state the Court decided to reduce the minimum eligibility by 25 marks to sit for the main examination but that was based in the given facts and circumstances and taking into consideration that the total number of applicants for the vacancy of judicial officers was about 21000 only but in the present case the number of applicants runs into lakhs and such an approach would frustrate the very object of holding a preliminary examination to weed out the non-serious students from the contention.
But Mr.Justice failed to consider that theDouble Bench didn’t bother about the number, that’s why 5155 candidates out of 21000 qualified for mains which is scheduled to be held in this month. Although this is the rule if no. of candidate is more than 40 thousand then PT will be taken. Then why BPSC taken PT for Judiciary exam. So, it is clear that number game is not the problem for BPSC but Mr.Tripathy has taken so many care of it. In his own word, he tried to end the further scope of litigation by excluding selected candidates copy for fresh evaluation. But this is not the justice. He accepted negative approach on the basis of old citation Ganesh Yadav v.state 1995(2-PLJR 170 instead of Akshey Lal Pandit Judicial case and approval of Supreme Court on the same. And compelled the student to struggle for the justice.
I also point out one fact about qs no.134 of B set.. In India, per capita consumption of energy in 1994 was.. ans is D (pl. refer Dutta & Sundaram p.36)
So, by lowering cut off by 9 marks in each category is the last solution which will be accepted by all section, otherwise litigation will be further stretched…
I wish to suggest successful candidates, pl. leave this blog and focus on your studies. Now u have ample time to prepare and revise it thrice..

Bpsc should fix no of students clearg pt shud d 13times of d seats as done by upsc. all failed students shud conc on thr studies so as to avoid this mess. otherwise for every exam thy need a lawyer.
